You are responsible for choosing the company you hire and for checking its licences, certifications and insurance. We are not liable for the work or conduct of the service companies, and any agreement for work is solely between you and the company.

1. Acceptance of these terms

By accessing or using Brantford Water Damage (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site. In these terms, “we”, “us” and “our” mean Brantford Water Damage.

2. Age requirement

You must be at least the age of majority in your jurisdiction of residence to use this Site. By using the Site, you represent and warrant that you meet this age requirement.

3. Purpose of the site

We operate as a free referral service run by an independent operator based in Ontario, Canada, connecting homeowners with local water damage restoration and mold remediation companies. Price ranges, guides, and other content on this site are for general informational purposes only. They are not guaranteed quotes, nor do they constitute professional or legal advice. In an emergency involving safety, call 911 or your utility provider. Check insurance details with your insurer before acting.

4. Client responsibility and due diligence

Brantford Water Damage operates strictly as a lead referral service. When you submit a request, we pass your information to an independent third-party partner company.

While we aim to connect you with professionals capable of handling water damage and mold remediation, it is your sole and absolute responsibility to verify the partner company’s credentials before hiring it. You agree that you are independently responsible for checking and confirming the partner company’s credentials, including, but not limited to:

• The validity of all necessary trade licences.

• Mold removal, water damage repair, or other specialized certifications (for example, IICRC).

• WSIB coverage, liability insurance, and bonding.

• Permits required by the City of Brantford or your local municipality.

We do not independently verify, warrant, or guarantee the licences, certifications, or insurance status of any company or contractor we refer you to.

5. Independent companies

The local service companies we connect you with are independent businesses, not our employees, subcontractors, or agents. They set their own prices, schedules, and warranties. Any agreement for work, assessment, or payment is strictly between you and that company. How we share your details is explained in our Privacy Policy.

6. No warranty and no guarantees

The Site and its content are provided “as is” and “as available,” without warranty of any kind. We do not guarantee response times, availability, pricing, quality of work, or results of the independent service companies.

7. Limitation of liability

To the maximum extent permitted by law, Brantford Water Damage and its operators shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Site, reliance on its information, or the work, advice, or conduct of the local service companies we connect you with.

8. Indemnification

You agree to indemnify and hold harmless Brantford Water Damage, its owner(s), operators, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising directly from your misuse of the Site, your submission of false or fraudulent information, or your intentional violation of these Terms.

9. Acceptable use

You agree not to use the Site for any unlawful purpose, attempt to interfere with the Site’s operation or security, or scrape the Site at scale or for commercial republication without permission.

10. Intellectual property

Original text, structure, code, and graphics on the Site are the property of Brantford Water Damage and are protected by Canadian copyright law. You may not republish substantial portions without permission.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the provincial or federal courts located in the Province of Ontario. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Changes to these terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without prior notice. If we make changes, we will post the new version on this page and update the “Last updated” date at the top. Changes apply to your use of the Site only after they are posted. Your continued use of the Site after any changes are posted constitutes your acceptance of the new Terms.
